1. Acceptance of Terms

By installing, accessing, or using the PumpWork AI Chrome extension ("the Extension") and related services provided by Devviy.com ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Extension.

2. Description of Service

PumpWork AI is a productivity tool for Upwork freelancers that provides:

• A real-time job feed displayed in Chrome's side panel
• Job evaluation based on your custom filters and preferences
• AI-generated proposals (i.e. cover letters) personalized to your profile and each job listing
• One-click proposal autofill on Upwork's application pages

The Extension operates alongside your existing Upwork session and communicates with Upwork API for job feed and basic account information and our backend API at pumpwork.devviy.com for job feed processing and account management.

3. Account and Registration

To use the Extension, you must have an active Upwork account and verify your email address with PumpWork AI. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

As a user of the Extension, you agree to:

• Use the Extension in compliance with all applicable laws, regulations, and third-party terms of service, including Upwork's Terms of Service
• Review and personalize all AI-generated cover letters before submitting proposals on Upwork
• Not use the Extension to send spam, misleading proposals, or engage in any form of platform abuse
• Not attempt to reverse-engineer, decompile, or modify the Extension
• Not use the Extension in any way that could impair its performance or interfere with other users' access

5. Our Approach to External APIs

We are committed to the responsible and ethical use of external APIs. The Extension interacts with the Upwork platform using the minimum necessary API calls to deliver its core functionality. We continuously test the Extension with dedicated testing accounts to ensure that our API usage remains minimal, well-behaved, and free from bugs that could cause unintended activity.

We do not engage in aggressive scraping, excessive polling, or any behavior designed to circumvent rate limits or platform restrictions. Our goal is to complement the Upwork experience, not to exploit it.

6. Subscription and Payments

The Extension offers a free trial period. After the trial, a paid subscription is required for continued access. AI-powered features (proposal data generation i.e. cover letter etc.) consume tokens, which can be purchased additionally when needed.

• Payments are processed securely through WayForPay. We do not store your payment card details.
• Subscription fees are billed according to the plan selected at the time of purchase.
• Each subscription plan includes a certain amount of tokens. Additional tokens can be purchased when needed. Unused tokens remain in your account until consumed.
• Subscription fees and tokens are non-refundable once purchased.
• We reserve the right to modify pricing with reasonable advance notice.

7. AI-Generated Content

Proposal data (cover letters etc.) generated by the Extension are created using artificial intelligence powered by OpenAI and are intended as starting points. The job information, resume data and custom prompt(s) are processed through our backend using OpenAI. You are solely responsible for reviewing, editing, and approving all AI-generated content before use. We do not guarantee the accuracy, quality, or suitability of AI-generated content for any particular purpose.

8. Intellectual Property

The Extension, including its code, design, and branding, is the intellectual property of Devviy.com. You retain ownership of any personal data, resume content, and custom prompts you provide to the Extension. AI-generated content produced using your data and prompts are yours to use as you see fit.

9. Data Practices

We collect and store only the data necessary to provide the Extension's core functionality. All data stored on our servers is encrypted at rest and in transit. We do not retain data beyond what is needed to deliver the service.

• Upon account deletion, all associated data is permanently removed from our servers within 30 days.
• Accounts that remain inactive for more than 180 days may be automatically deleted, along with all associated data.
• Local data stored by the Extension is cleared immediately when you uninstall it from your browser.

10. Disclaimer and Limitation of Liability

This extension is an independent product and is not sponsored, approved, or maintained by Upwork Global Inc. or any of its related companies. For the official Upwork platform, visit upwork.com.

The Extension is provided on an "as is" and "as available" basis. While we strive to deliver a reliable and high-quality experience, we make no warranties regarding uninterrupted service, error-free operation, or compatibility with future changes to third-party platforms.

Users are encouraged to familiarize themselves with the terms and policies of any third-party platforms they use alongside this Extension. We cannot be held responsible for any consequences arising from the use of third-party services, and users acknowledge that they use the Extension at their own discretion.

To the maximum extent permitted by law, Devviy.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Extension.

11. Termination

We reserve the right to suspend or terminate your access to the Extension at any time for violation of these terms or for any conduct that we reasonably believe is harmful to other users, us, or third parties. You may stop using the Extension at any time by uninstalling it from your browser.

Upon termination, your right to use the Extension ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) shall remain in effect.

12. Changes to These Terms

We may update these Terms of Service from time to time. If we make significant changes, we will notify you by updating the "Last Updated" date at the top of this page. Your continued use of the Extension after changes constitutes acceptance of the updated terms.
